Effective Date: June 1, 2026
Welcome to Custom Caddy Works (the “Site”). These Terms and Conditions (“Terms”) govern your use of our website, located at CustomCaddyWorks.com, and the purchase of any custom golf carts, merchandise, or accessories from us.
By accessing our Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site.
1. Account Creation and E-Commerce
To purchase items , you may wish to create an account via our WooCommerce platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.
2. Custom Orders, Specifications, and Approvals
Because our golf carts are built-to-order based on your unique specifications:
- Design Accuracy: You are solely responsible for ensuring that all selections made in the online cart configurator (including colors, lift kits, seating, battery types, and accessories) are accurate before submitting your order.
- Finality of Custom Orders: Once a custom build order has entered the production phase, the order cannot be modified, changed, or canceled.
- Production Lead Times: Any production and assembly timelines provided on the Site are estimates only. We are not liable for delays caused by parts shortages, shipping bottlenecks, or custom manufacturing complexities.
3. Pricing and Payments
- Pricing Errors: In the event that a product or custom option is mistakenly listed at an incorrect price, we reserve the right to refuse or cancel any orders placed for that product.
- Payment Terms: Payment must be received in full, or authorized via our third-party financing/payment processors, before your custom build begins production.
4. Shipping, Delivery, and Freight Policy
Golf carts are heavy freight items and require specialized delivery:
- Freight Delivery: Standard delivery is typically curbside via a third-party Less-Than-Truckload (LTL) freight carrier. You must ensure that the delivery address is accessible to large freight trucks.
- Inspection Responsibilities: You must inspect the golf cart thoroughly upon delivery before signing the carrier’s Bill of Lading (BOL). Any cosmetic or structural damage caused during transit must be noted explicitly on the BOL. If damage is severe, you must refuse the delivery and contact us immediately. Signing the BOL without noting damage releases the carrier and [Your Company Name] from transit damage claims.
- Risk of Loss: The risk of loss and title for the golf cart pass to you upon our delivery of the item to the freight carrier.
5. Returns, Refunds, and Cancellations
- Custom Golf Carts: All sales of custom-built golf carts are final. We do not accept returns or offer refunds on custom vehicles unless the vehicle arrives with an unfixable mechanical defect covered under warranty.
- Shirts and other merchandise: Unused, clean merchandise in their original packaging may be returned within 30 days of delivery, subject to a 15% restocking fee. Return shipping costs are the responsibility of the customer.
6. Vehicle Safety and Proper Use
By purchasing a golf cart from us, you acknowledge and agree that:
- Golf carts are motorized vehicles and must be operated in accordance with all local, state, and federal laws (including age restrictions, street-legal requirements, and registration if applicable).
- You will ensure all operators read the safety manual and operate the vehicle responsibly.
- Modifying the vehicle after delivery (e.g., bypassing speed governors or altering electrical systems) voids any applicable warranties and is done entirely at your own risk.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Custom Caddy Works shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, property damage, loss of profits, or data arising out of or connected to the use, operation, or inability to use any golf cart or product purchased from our Site.
8. Governing Law
These Terms and any disputes arising from your use of the Site or purchase of our products shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of law principles.
